BELOW ARE THE TERMS AND CONDITIONS THAT HAVE BEEN CAREFULLY WRITTEN AND PLACED TO PROTECT YOU ("THE CLIENT/CUSTOMER") AND MYSELF ("HEATHER MAE'S CREATIVE SERVICES"). IT IS RECOMMENDED THAT YOU VIEW THESE TERMS PRIOR TO PURCHASING OR CONTACTING ME FOR PROJECTS.
PAYMENTS + PRICING
All pricing at Heather Mae's Creative Services is subject to change at any time and becomes effective upon posting to this site. If there has been an agreed pricing between Heather Mae and the client before changes have been made, it will remain valid until that project is complete. For projects $499 and under, payment in full is required before work will begin. For projects over $500, a non-refundable payment of at least 50% is required before any work will begin. Unless purchasing directly from the site, full payment or deposits must be paid within 24 hours of receipt of invoice or the project is subject to cancellation. All remaining unpaid balances will be due within 24 hours of your final approval of the design concept. Once the final payment is made, the project will be finalized and all files will be sent to you.
Currently, payments are all made via PayPal or with a debit/credit card. No project will begin until payment has been 100% cleared.
REFUNDS + CANCELLATIONS
Heather Mae's Creative Services does not provide refunds for any services unless agreed upon. Having buyers remorse or wanting to use another company instead is not a suitable means for a refund. Once payment has been made to Heather Mae's Creative Services the project will begin in the time frame given to the client. It is advised that you give the project ample time for completion for these reasons: revisions may be needed, it may be a peak in the orders received and prior work received may take longer than expected. I provide a suitable time frame, however, there may be an additional business day or two needed before I can begin if it is a busy time. If for any reason you want to cancel a service already rendered or paid for, that is your choice. However, due to the work produced or in queue, payments already received by Heather Mae's Creative Services will not be refunded in order to offset the loss of business. If partial work has already been received by the client and they choose to cancel, the partial or full payment that has been paid will not be refunded. Ownership of all artwork, layouts and development will remain the property of Heather Mae's Creative Services and remaining work will not be sent to the client for their ownership. If the project is in it’s final stage, ownership will be transferred to client after full payment is received.
The only reason any monies will be refunded is in the event Heather Mae's Creative Services is unable to complete the project for personal reasons or illness.
DRAFTS
Draft images of ANY kind are for the purpose of approval only. They may not be copied, manipulated, or distributed to any other person or company other than those directly involved with the project without prior permission from Heather Mae. All drafts works are the property of Heather Mae's Creative Services.
REVISIONS
For all projects done by Heather Mae's Creative Services there is a three (3) revision limit. After that, all additional revisions will incur a $5 fee per revision. For larger scale projects like web design, the number of revision is limited to 4. This is to ensure a steady work flow so your project can be completed in a reasonable time frame.
DESIGN CONTENT
It is important to have a vision of some kind for your business so it can be relayed to me. If you want me to freestyle my ideas for your project, keep in mind our creative visions may not match. This can lead to more revisions than needed. It is best to at least have some form on concept on the project you are purchasing. Clients are required to submit all HIGH QUALITY photos and/or verbiage (text) they need for their project. Pixelated photos will not result in the best quality design. Please refrain from submitting dull phone images. Please make sure all submitted content is spell checked and not subject to copyright. Heather Mae's Creative Services may revise submitted content if deemed necessary for the the project. Any revisions on my end will be communicated first.
TIME FRAMES
It is extremely important for Heather Mae's Creative Services to complete projects in a timely manner. However, due to the uniqueness of each project and client, more time may be needed for satisfied completion. Please be advised that this relates to business days only. Weekends and Holidays are not included in the time frame of any project.
CONTENT DELIVERY FILES/POLICY
All design only projects are sent to you ("The Client/Customer") in the form of email from me ("Heather Mae's Creative Services"). Logo designs will always be sent in JPG, PNG, and .EPS format. There is no additional charge for the vector format as this is an essential file format that can be scaled to any size. Other digital projects (flyers, business cards, website graphics, etc) are sent in JPG or PNG format. If a PDF file is needed, Heather Mae's Creative Services will need to be contacted to supply that for you.
All core PSD or .AI files remain the property of Heather Mae's Creative Services even if a copy has been supplied to you. Once a project has been finalized and the files have been delivered to you, (with the exception of core files) you own the rights to what you have purchased. Copyrighting and/or trademarking your logo is solely up to you and not the responsibility of Heather Mae's Creative Services.
CANCELLATIONS
The Designer must be notified within 24 hours of the start of all projects if the Client must cancel services agreed upon in this contract. In the event of cancellation of this assignment, ownership of all copyrights and the original artwork shall be retained by Designer, and Designer shall be compensated by the Client for the services rendered through the date of cancellation plus a 20% Cancellation Fee.
OWNERSHIP OF ORIGINAL ARTWORK
The Designer retains ownership of all original design/artwork, whether preliminary or final. The Client shall return such artwork within 30 days of use unless indicated otherwise in proposal.
ACCREDITATION/PROMOTIONS
Designer retains the right to reproduce, publish and display the deliverables in Designer’s portfolios and websites, and in galleries, graphic design periodicals and other media or exhibits for the purposes of recognition of creative excellence or professional advancement, and to be credited with authorship of the Deliverables in connection with such uses.
RELEASES
The Client shall indemnify the Designer against all claims and expenses, including reasonable attorney fees, due to uses for which no release was requested in writing or for uses that exceed authority granted by a release.
MODIFICATIONS
Modification of the Agreement must be written, except that the invoice may include, and the Client shall pay, fees or expenses that were orally authorized in order to progress promptly with the work.
WARRANTY OF ORIGINALITY
The Designer warrants and represents that, to the best of her knowledge, the work assigned is original and has not been previously published. The Designer reserves the right to replicate, reproduce or modify all her original design/artwork, or consent to use of all work or portions thereof obtained through the undersigned from third parties if previously published by the Designer. Consent to use must be obtained on an unlimited basis. This warranty does not extend to any modifications that the Client or others may make of the Designers product and the Designer will not be liable if reproduced design/artwork is compromised. Client expressly agrees that it will hold the Designer harmless for all liability caused by the Clients use or modification of the Designers product.
LIMITATION OF LIABILITY
The services and the work product of designer are sold “as is.” In no event shall designer be liable for any lost data or content, lost profits, business interruption or for any indirect, incidental, exemplary or punitive damages arising out of or relating to the materials or the services provided by designer.
ACCEPTANCE OF TERMS
Your acceptance of work shall evidence acceptance of these terms.
Once completed, you (the client) also give Heather Mae's Creative Services the right to use for portfolio and/or marketing purposes unless agreed upon otherwise.
Please Note: Completed print or digital designs will not be edited without additional fees. Designs cannot be replicated, reproduced, stolen or copied, edited or revised without permission or consent from the Designer. Doing so is a breech of trust and violation of the terms and conditions of Hey Heather Mae, LLC.
